Terms of Service

These terms of service ("Terms of Service") govern the use of the Prime Padel court facility ("Facility") provided by Mint Media Sports Pte. Ltd. and the operator Prime Padel ("Prime Padel" and collectively, “we”, “our” or “us”) to any person booking courts or attending the Facility in relation to that booking either as player or guest ("You").

Facility as used herein shall mean any physical location, area or venue to which we give you access for the purpose of engaging in the activity of playing Padel. By using the Prime Padel website (the “Website”) and the Facility, you agree to be bound by and comply with any additional terms, conditions and policies provided by the owner of the premises where the Facility is located (“Building Owner”), tenant, and property manager of the Facility (collectively, the “Property Managers“) relating to the use of the Facility, including compliance with building security procedures, IT access and use procedures provided by the Property Managers (the “Manager’s Policies“).

By using the Website and the Facility, you accept the Terms of Service set out herein. Furthermore, the use of the Website and Facility means that you also agree to our Privacy Policy. We have the rights to amend these Terms of Service from time to time. We may do this for a variety of reasons including to reflect changes in or requirements of the law, new features, or changes in business practices. If the changes include material changes that affect your rights or obligations, we will notify you in advance of the changes by reasonable means, which could include notification through the website or social media platforms.

Booking and Payment

You must make a reservation in advance to book the Facility. Reservations are open two weeks in advance and can be made through Prime Padel’s App, Website or direct with the Facility subject to availability.
You shall provide accurate and complete information during the booking process, including the desired date, time, and duration of the booking.
Payment for the booking shall be in the form of cashless payments and made at the time of booking, unless otherwise agreed upon by Prime Padel.
Walk-in bookings will only be entertained if play is to commence immediately or shortly thereafter, subject to court availability. There will be no refunds for walk-in bookings.
Credits credited to your account can only be used for court bookings. For the avoidance of doubt, credits cannot be used for purchasing merchandise, refreshments or rental or rackets.

Facility Usage

The Facility will only be available for booking during the designated operating hours. You shall adhere to the designated time slot allocated for their booking.
Appropriate apparel, including footwear designed for racquet sports, shall be worn on court and may also be worn throughout the Facility.
You are responsible for bringing their own Padel equipment, such as racquets and balls. Prime Padel may offer rental equipment subject to availability and separate charges. Prime Padel will display such charges at the Facility or you can ask for the charges at the Facility’s reception.
You shall follow Prime Padel’s safety instructions and guidelines and shall conduct yourself in a respectful and sportsmanlike manner.
Changing rooms are available at the Facility. You may ask the Facility’s reception for directions to the changing rooms. Save for the foregoing, please note that Prime Padel does not have the right to grant you access or use of any other amenities at the location of the Facility.
The smoking of cigarettes and electronic cigarettes / vapes is strictly prohibited at the Facility. Out of consideration to other guests and nearby residents, playing of loud music is not permitted. Pets are not allowed at the Facility.
You may not charge any fee to any person in connection with the use of the Facility whether for private lessons or otherwise without Prime Padel’s express written consent.
Prime Padel reserves the right to refuse service, terminate bookings, or deny access to the Facility to anyone who violates these Terms of Service, engages in unsafe behaviour, or poses a threat to others’ safety or the Facility.

Use of Website and Facility by Minors

All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Website and the Facilities. If you are a minor, you must have your parent or guardian read and agree to these Terms of Service prior to you using the Website and the Facilities. Minors using the Facilities are encouraged to be accompanied by their parent or guardian.

Retail and Merchandise

All retail and merchandise sales are not refundable.

Rescheduling, Cancellations and Refunds

You will be allowed to reschedule your bookings up to 24 hours prior to your scheduled booking.
Refunds will be provided for any cancellation of bookings done 24 hours prior to the scheduled booking. Such refunds will be by way of crediting into your account the equivalent amount of booking fees paid. For the avoidance of doubt, no cash refunds will be provided.
NO refunds will be provided for cancellations less than 24 hours prior to the scheduled booking.
Prime Padel may at its sole discretion cancel the booking due to health and safety concerns or any other unforeseen circumstance and will make reasonable efforts to reschedule the booking or provide a refund.

Inclement Weather

The following terms and conditions apply in the case of inclement weather which results in stoppage of play:

if you have a booking, you may call the Facility within 1 hour from the time of your scheduled booking to arrange a “rain-reschedule”. Alternatively, please drop us an email at hello@primepadelsport.com. We will do our best to accommodate your preferred timing, subject to availability.
If you form part of a group lesson, we will notify you no less than 1 hour before the activity is due to commence. If the lesson cannot continue, your booking will be carried over to a subsequent group lesson. We will do our best to accommodate your preferred timing, subject to availability. No refunds will be given.

Open Matches

Players who sign up for Open Matches are required to make payment upon signing up.
Open Matches will be cancelled if slots are not filled up 24 hours prior to the scheduled match time.
There shall be no cancellation of Open Matches less than 24 hours prior to the scheduled match time. If an Open Match is cancelled more than 24 hours prior to the schedule match time, you will receive a refund by way of crediting into your account the equivalent amount of booking fees paid.

Damage of Facility

You are responsible for leaving the Facility (including any property at the Facility) in the condition it was in when you arrived. You are responsible for the cost of repair for damage to, or necessary cleaning of, the Facility resulting from your violation of these terns and conditions or your use of the Facility in excess of normal “wear and tear.” If Prime Padel, in its reasonable discretion, determines that excessive repair or cleaning is required, Prime Padel reserves the right to charge the payment method designated in your Account for the reasonable cost of such repair and/or cleaning, as well as an additional service fee which shall not exceed $500 Singapore Dollars per occurrence and you agree to be responsible for payment of same. Any such amounts are non-refundable and at the reasonable discretion of Prime Padel.

Liability and Indemnity

You acknowledge and agree that your use the Facility is at your own risk and that taking part in the activity may through no fault of ours result in injury, permanent incapacity or death. We shall not be liable for any injuries, damages, or losses incurred by you while using the Facility except in cases of gross negligence or wilful misconduct by us and that the total damages for injury, property damage and loss is limited to the price paid for the booking.

You agree to defend, indemnify, and hold us, our directors, employees, officers and agents harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) use of the Website; (2) breach of these Terms of Service; (3) any breach of your representations and warranties set forth in these Terms of Service; or (5) any overt harmful act toward any other user of the Website with whom you connected via the Website. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

If at any time you feel unwell in any sense they must cease play, inform our staff and seek proper medical assistance. You accept the risks of playing Padel and warrants that you and your guests are healthy and will wear appropriate sports equipment to minimise the possibility of injury and accepts that failure to do so will be entirely at your own risk and that you will indemnify us against all claims, damages, liabilities, costs, or expenses arising from your participation and use of the Facility.
The quality and safety of the buildings in which the Facilities are located are entirely the responsibility of the Building Owners. You acknowledge that by using the Website and the Facility, you may be exposed to locations that are potentially dangerous, offensive, harmful to minors, unsafe or otherwise objectionable, and that you use the Website and the Facilities at your own risk.
You understand and agree that you obtain or otherwise download content, material or data through or for the use of the Website at your own risk discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material or data and/or use of the Website. In addition, we do not represent that or warrant that the information accessible via our Website is accurate, complete or up to date.

Loss or Damage of Personal Property

We are not responsible or liable for any loss, damage or theft of your personal property within the Facility.

Intellectual Property Rights

Nothing in this Terms of Service will be interpreted to grant you any rights to any and all logos, trademarks, service marks, and any other intellectual property rights associated with Prime Padel, including the “Prime Padel” logos and “Prime Padel” names and any other names of Prime Padel-related or products or service developed by Prime Padel (“Prime Padel Trademarks”). Without our written permission, you may not use any Prime Padel Trademarks for any Commercial Use, including to register any domain names or social media accounts using any Prime Padel Trademarks.

User Data

We will maintain certain data that you transmit to the Website for the purpose of managing the performance of the Website, as well as data relating to your use of the Website. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Website. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.

Entire Agreement, Governing Law and Jurisdiction:

By making a booking and using the Facility, you acknowledge that you have read, understood, and agreed to be bound by the Terms of Service.

These Terms of Services and any policies or operating rules posted by us on the Website or in respect to the Website constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Service shall not operate as a waiver of such right or provision. These Terms of Service operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Terms of Service is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms of Service and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Terms of Service or use of the Website. You agree that these Terms of Service will not be construed against us by virtue of having drafted them. You hereby waive any and all defenses you may have based on the electronic form of these Terms of Service and the lack of signing by the parties hereto to execute these Terms of Service.
These Terms of Service shall be governed by the laws of Singapore. Mint Media Sports Pte. Ltd. and yourself irrevocably consent that the courts of Singapore shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
